The sale is listed and sold pursuant to the North Carolina Judicial Sales Act, N.C. Gen. Stat. Chapter 1, Article 29A. Once the initial offer is accepted by the Commissioner, a report of sale must be filed with the Clerk of Court pursuant to NC Gen. Stat. §1-339.35. That initial offer to purchase is subject to upset bid or bids that must be filed with the Clerk of Court pursuant to NC Gen. Stat. §1-339.36. After the report of sale has been filed with the Court and more than 10 days have passed without an upset bid then the Commissioner shall file a motion to confirm the sale pursuant to NC Gen. Stat. §1-339.37. Once confirmation of the sale by the Court has been had, then and only then shall the Commissioner have the authority to deliver the property to the highest bidder.

If the ten day upset bid period is still open any interested party can file an upset bid with the Clerk of Court. The Clerk of Court will require a deposit with each bid. You should contact the Clerk of Court for the amount needed to be deposited for an upset bid. Any deposit filed with the Court will not be credited at closing by the Commissioner. Any upset bidder that deposits funds with the Court will have to work with the Court directly on having the funds returned to that bidder.
